STATE OF KENTUCKY
EXECUTIVE DEPARTMENT
FRANKFORT, Jan., 3rd, 1899

WHEREAS, on the 26th day of December, 1898, FOUNT TANKERSLY, a convict in the State Penitentiary at Eddyville, Ky., who was sentenced to the said Penitentiary by a judgment of the Garrard Circuit Court for life, and was committed to said Penitentiary on September 18th, 1885, was found to be a lunatic by the verdict of a jury and the judgment of the Lyon County Court, and ordered to the asylum.

NOW THEREFORE, in order to authorize his release from the Penitentiary, and confinement in said Asylum, his sentence and punishment is respited, it being distinctly understood that in the event his mind should be restored, he shall be returned to the said Penitentiary in order to serve during the remainder of his life.

FRANKFORT, Jan., 3rd, 1899

Whereas, AMOS BROOKS was sentenced to the State Penitentiary by judgement of the Jefferson Circuit Court for eighteen years on a charge of arson, and sent to the Penitentiary on June 8th, 1889, and is yet there confined; and, whereas, on the 28th day of September, 1898, he was found to be a lunatic by the verdict of a jury, and the judgment of the LYON COUNTY COURT, and ordered to the Asylum;
NOW, THEREFORE, in order that he may be released from the Penitentiary and confined in the Asylum, his sentence and punishment is respited. This is done, lowever, with the distinct condition that in the event his mind should be restored he shall be returned immediately to the said Penitentiary, there to serve out the residue of his time, beginning as of the date of his release from the Asylum.
In testimony of which, the GREAT SEAL of the Commonwealth, and my signature are hereto attached.

Euphratus Holland ] Lunatic

This day J D Lester, Attorney for the Commonwealth, filed an information as follows, to-wit:

To Hon. W L Crumbaugh, Judge of the Lyon County Court:
I am reliably informed that Euphratus Holland is a person of unsound mind, and a lunatic and therefore ask that a jury be impaneled to pass upon the subject.

Ordered by the Court, That T J Watkins Esq, an Attorney of this Court, be and he is hereby appointed to defend for and on behalf of the person under trial.

To inquire, etc., comes a jury to-wit: P A Beck, Bart Gray, John R Smith, Sidney Lady, J H Holloway, J D Woodson, C W Davis, J T Moneymaker, W ? Walls, B F Smith, S P Glenn & T H Callahan

who being duly impaneled and sworn according to law, after hearing the evidence, returned the following verdict, viz: We of the jury find from the evidence that Euphratus Holland is a person of unsound mind and a lunatic; that the unsoundness of mind is from cause unknown that he was born in Ky, and resides in Lyon Co Ky and is 50 years old; that he was not brought into this State for the purpose of becoming a charge upon the Commonwealth; that he owns 100 acres land valued at $700 & some personal property - $150.00 his father and mother are dead and said Euphratus Holland is not capable of laboring either in whole or in part for his support.

wherefore it is adjudged by the Court that said Euphratus Holland is of unsound mind and a violent lunatic and that he be immediately conveyed to the asylum at Hopkinsville Kentucky, and John L Smithis appointed to convey him to said asylum and he is allowed _____ guard.
