Mrs Emma Duncan

This day J S Hodges Attorney for the Commonwealth filed an information as follows, to-wit: To T P Gray Judge of the County Court: I am reliably informed that Mrs Emma Duncan is a person of unsound mind and a lunatic (Lunatic or Idiot) and therefore ask that a Jury be impaneled to pass upon the subject.

Ordered by the Court, That _____ Esq an Attorney of this Court be and he is hereby appointed to defend for and on behalf of the person under trial.

To inquire, etc., comes a Jury, to-wit: Minus Dillingham, John Crumbaugh, W B [unreadable], W Lucket, Harry Cul[unreadable], John C[unreadable], W L Crumbaugh, Harrison ?ang??, C W Salyers, G E [unreadable], H C Graso, J M Hugh??.
Who being duly impaneled and sworn according to law, after hearing the evidence returned the following verdict, viz: We of the jury find from the evidence that Mrs Emma Duncan is a person of unsound mind and a lunatic; That the unsoundness of mind has existed since _____: that _he was born in Mo. (State or Country) and resides in Lyon County and is 49 years of age; that _he was not brought into this State for the purpose of becoming a charge upon the Commonwealth; that _he owns a life interest in $500.00 worth of land it is mortgaged no estate of any kind; that her father is dead and mother is dead and reside in _____ and ha_ not estate _____ sufficient to support the person under trial; and said she is [sic] is not capable of laboring either in whole or in part for her support.

Natural temper and disposition toward relatives: no; Any threat, attempt of tendency to injure self or others? _____; Violent? yes; Destructive? _____; Cleanly? yes; Periodic frenzy and lucid intervals and duration of each: _____; What restraints have been imposed and what treatment used: none;
Any injury about the head ever received? no; Any bodily disease from suppression of evacuations, eruptions, sores or injuries? no; What estate have the parents, husband or wife of the person under trial? none;
“Together with whatever else may be deemed material toward enabling the superintendent of the asylum to understand the case.”



Wherefore it is adjudged by the Court that said Mrs Emma Duncan is a person of unsound mind and a lunatic; (Lunatic or dangerous Idiot); it is ordered that _he be committed to the asylum for the insane at Hopkinsville Ky., and that the superintendent of said asylum be immediately notified and directed to send for said lunatic

Morris Banks

This day J S Hodges Attorney for the Commonwealth filed an information as follows, to-wit: To Hon. T P Gray Judge of the Lyon County Court: I am reliably informed that Morris Banks is a person of unsound mind and a lunatic (Lunatic or Idiot) and therefore ask that a Jury be impaneled to pass upon the subject.

Ordered by the Court, That N W Utley Esq an Attorney of this Court be and he is hereby appointed to defend for and on behalf of the person under trial.

To inquire, etc., comes a Jury, to-wit: Bill Miles, Geo. Prince, C J Gresham, Urey Cummins, Chas. Cummins, D J Hensley, [unreadable] Ladd, W L Crumbaugh, Willard Town, E H James, J M Tally and Frank Tanner.
Who being duly impaneled and sworn according to law, after hearing the evidence returned the following verdict, viz: We of the jury find from the evidence that Morris Banks is a person of unsound mind and a lunatic; That the unsoundness of mind has existed since to some extent since childhood: that _he was born in Todd Cty Ky (State or Country) and resides in State Prison Lyon County and is 34 years of age; that _he was not brought into this State for the purpose of becoming a charge upon the Commonwealth; that _he owns no estate of any kind; that his father is living and mother is living and reside in Todd Cty Ky and have only amount of property sufficient to support the person under trial; and said Morris Banks is not capable of laboring either in whole or in part for his support.

He was confined in the State Prison some 5 years ago for having murdered his aunt and it is understood that in case he should be cured he is to be returned to prison.
